JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioners are aggrieved by the Official Memorandum dated 17.01.2024 [Annexure - J] issued by the Deputy Commissioner, Kolara District, Kolar [the fifth respondent]. Mr. H. Venkatesha Dodderi, the learned counsel for the petitioners, arguing in support of this grievance had submitted before this Court on 14.08.2025, had contended that, because the petitioners are from the marginal section of the society, they are being pushed to a village which is far from where they have been given the land. 2. This Court has prima facie opined thus, - 9 - HC-KAR NC: 2025:KHC:37765 WP No. 22779 of 2025 "Mr. H. Venkatesha Dodderi, the learned counsel for the petitioners, submits that 9 [Nine] acres of the land granted to the petitioners who are from the marginal section of the society, including those formerly within the devadasi system cancelled on the ground that the afore extent overlaps with the land that is acquired for the benefit of the Karnataka Industrial Areas Development Board [KIADB], but it can be demonstrated that the very extent of the land is earmarked/granted for the purposes of construction of quarters for the Deputy Superintendent of Police and other Police Personnel and also for other purposes. Mr. H. Venkatesha Dodderi asserts that the petitioners, because they hail from the marginal section of the society, are being pushed to a village which is far from where they have been given the land where the Slum Board [the seventh respondent] must commence construction." 3. In terms of the liberty that is reserved, the Deputy Commissioner, Kolar District, Kolar has filed - 10 - HC-KAR NC: 2025:KHC:37765 WP No. 22779 of 2025 an affidavit, which in so far as the petitioners read as under, "10. I state that a committee was constituted under the Chairmanship of the Deputy Commissioner, Kolar and accordingly on 17.04.2025 it was decided to reserve 4 acres of land in Sy.No.29 of Mallampalliryagadahalli village, Robertsonpet Hobli, KGF Taluk. It was further decided to allot the said land to the daily wage workers of K.G.F. and put-up ground and 1st floor model constructed houses on the aforesaid land measuring to an extent of 4 acres and the same being allotted to the necessary beneficiaries. Accordingly, the Deputy Commissioner, Kolar, by its order No.LND.CR/37/25-26, dated 22.08.2025 reserved 4 acres of land in Sy.No.29 of Mallampalliryagadahalli village, Robertsonspet Hobli. Copy of the proceedings dated 17.04.2025 and Order dated 22.08.2025 are produced herewith and marked as ANNEXURES 'R6' and 'R7' respectively for kind perusal of this Hon'ble Court. 11. I state that it is pertinent to state that apart from the land measuring 4 acre the adjacent land measuring to an extent of 6.16 - 11 - HC-KAR NC: 2025:KHC:37765 WP No. 22779 of 2025 acres in Sy. No.29 of Mallampalliryagadahalli village, Robertsonpet Hobli, Kolar District, has also been reserved to be allotted to the Houseless people by the Commissioner, Town Municipal Corporation, K.G.F. Taluk. 12. I state the proposed alternative in land Sy.No.29 measuring to an extent of 4 acres is 3 k.ms. away from the K.G.F.Town and the land which was earlier granted was 6 k.ms. away from K.G.F.Town. Therefore, there would be no hardship caused to the petitioners whatsoever." 4. Mr. H. Venkatesha Dodderi submits that this Court could dispose of this petition taking on record the afore statements as that would be in redressal of the petitioners' grievance but directing the fifth respondent to ensure that timely action is taken and the petitioners' legitimate expectation of a roof over their heads is not shattered by delay. The petition stands disposed of in the light of the submissions made with liberty to the petitioners to file a representation with the Deputy Commissioner, - 12 - HC-KAR NC: 2025:KHC:37765 WP No. 22779 of 2025 Kolar District, Kolar [the fifth respondent] for timely execution of the project that is contemplated.
