1. Present petition has filed by the petitioner under Article 226 of the Constitution of India challenging the order dated 10.02.2015 (Annexure P/2), whereby the claim for family pension has been rejected on the basis of Rule 47 of the Chhattisgarh Civil Service (Pension) Rules, 1976. The petitioner has filed the present petition with the following reliefs:
“(i) That, this Hon'ble Court may kindly be pleased to declare Ultra-virus fixing of maximum age limit of 25 years for providing family pension under rule 47 of the Chhattisgarh Civil Service (Pension) Rules 1976 in respect of unmarried daughter, in the interest of justice. (ii) That, this Hon'ble Court may kindly be pleased to direct the State government to made relevant amendment, in rule 47 of the Chhattisgarh Civil Service (Pension) Rules 1976 regarding entitlement of family pension to unmarried, unemployed daughters State Government employees beyond 25 years, in the interest of justice. (iii) That, this Hon'ble Court may kindly be pleased to quash/set-aside the official letter dated 10.02.2015 (Annexure P-2) in the interest of justice. (iv) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”
2. At the outset, learned counsel for the petitioner seeks permission to withdraw the present petition. 3. The prayer made by counsel for the petitioner is not opposed by the
