THIS APPEAL COMING ON FOR CONCILIATION BEFORE THE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
3 CONCILIATION ORDER
Learned counsel appearing for appellants - claimants is present.
Learned counsel appearing for respondent – Insurance Company along with its representative are present.
2. After prolonged negotiations, matter is settled. A joint memo signed by learned advocate appearing for appellants/claimants (being authorized by appellants/claimants to sign) and learned advocate appearing for respondent-Insurance Company and its authorized officer is filed. Appellants-claimants have agreed to receive and respondent-Insurance Company has agreed to pay a lumpsum of Rs.9,00,000/- (Rupees Nine Lakhs), in addition to what has been awarded by Tribunal, in full and final settlement of claim.
3. Respondent - Insurance Company has agreed to deposit said amount before Tribunal within six weeks from date of preparation of award, failing which said amount shall carry interest at rate of 9% P.A. from the date of default, till date of deposit.
4. Out of enhanced compensation amount to be deposited by Insurance Company, Rs.2,00,000/- (Rupees Two Lakhs) each is
directed to be invested in Fixed Deposit in name of appellants no.2
4 and 3 in any Nationalized Bank/Scheduled Bank/Post Office for a period of 3 years with provision to seek for release in case they require it for higher education and with liberty to appellants/claimants to withdraw interest periodically. Remaining amount of Rs.5,00,000/- is ordered to be released in favour of appellant no.1, on proper identification.
5. This Miscellaneous First Appeal stands disposed of in terms of Joint memo. Judgment and Award of Tribunal shall stand modified accordingly. Draw up Award accordingly.
