The petitioner is aggrieved by the action of respondents 5 and 6 in restraining the petitioner from proceeding with the construction pursuant to the building permit order dated 05.09.2025. 2. The learned counsel for the petitioner submits that the petitioner purchased an extent of 128 square yards situated at Batwadipalem, Nellore, through a registered sale deed dated 09.02.2022, and subsequently applied for building permission. It is further submitted that an old house existed on the said site, which the petitioner intended to demolish to construct a new residential building. However, inspite of the grant of building permission, respondents 5 and 6, who are officials under the 2nd respondent, are preventing the petitioner from carrying out the construction. 3. The learned standing counsel for respondents 2 to 6 submits that, upon field verification, it was noticed that the petitioner has undertaken construction in Sy.No.513 instead of Sy.No.512/2. It is further submitted that the respondent authorities are willing to conduct a survey to determine the land where the petitioner is intending to construct. 4. Considering the submissions, the petitioner is directed to submit ‘F’ line application for conducting survey and to demarcate his property. The survey shall be conducted after issuing due notice to all concerned -3- W.P. No.28113 OF 2025 Date of order:14.10.2025 parties, and the entire exercise shall be completed within a period of four weeks. 5. Pending completion of the survey, no coercive steps shall be taken against the petitioner, and the petitioner shall not undertake any further construction during this period. 6.
