ORDER:
Heard the learned counsel for the petitioners and Sri P. Vengala Reddy, the learned Standing Counsel appearing for the respondent-Corporation. 2.
The learned counsel appearing for the petitioners submits that the petitioners have submitted representations to the respondent Nos.2 to 6, dated 20.03.2025 and 22.10.2025, seeking inclusion of Sy.Nos.267/1, 267/2 and 267/3 in the Dispute Register and to restrain further registrations and survey during the pendency of the civil suits. 3. It is submitted that the petitioners are contesting various civil disputes before the learned Principal Junior Civil Judge, Anantapuramu and the learned II Principal Junior Civil Judge, Anantapuramu, relating to the ownership, title and possession disputes over the above lands. 4. It is submitted that the petitioners are the plaintiffs in 5 Civil Suits, which are pending consideration. 5. It is submitted that when the parties to the suits are contesting the title disputes, the petitioners are apprehending creation of third party rights in LP.No.128/81 over the plots bearing Nos.46, 47, 48, 49 and plot Nos.19, 20, 29, 30 and 48 of Bandi Sreeramulu Layout. 6. It is submitted that in the event the third parties rights are created over the said lands, the same shall result in multiplicity of litigation. 4
7. Sri P. Vengala Reddy, the learned Standing Counsel appearing for the 3rd respondent submits that the 3rd respondent is not the competent authority to suggest maintaining the said lands as prohibited property under Section 22A(1) of the Registration Act, 1908. 8. It is submitted that the competent Court would have to pass an order restraining the alienation or transfer of the properties in dispute. However, it is submitted that the decision would have to be taken by the respondent Nos.2 and 6. 9. On the contrary, the learned counsel for the petitioners submits that the petitioners are seeking only the disposal of their representations dated 20.03.2025 and 22.10.2025, in accordance with law. 10.
Considering the same, the Writ Petition stands disposed of, directing the 2nd respondent to consider the petitioners’ representations dated 20.03.2025 and 22.10.2025 and pass necessary orders by issuing notices to all the concerned. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall also stand closed. ___________________ JUSTICE HARINATH.N SCH
