PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/ Accused No.1 on bail in Crime No.147 of 2025 of Taluka Police Station, Kadapa, YSR Kadapa District, registered against the Petitioner/ Accused No.1 herein for the offences punishable under Section 103(1) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2 2. Heard the learned counsel for the petitioner, the learned Assistant Public Prosecutor. 3. Mr. G. Vijaya Kumar, learned counsel for the petitioner, submits that the entire investigation has been completed and the charge sheet has also been filed. The case is now pending before the Sessions Court. The wife of the petitioner, being an orphan, has been residing in another person’s house since the date of the petitioner’s judicial custody, as she has no parents. The petitioner is suffering from an ulcer, is unable to take food properly, and therefore urged to enlarge the petitioner on bail. 3. Per contra, Ms. Akhila Naidu, learned Assistant Public Prosecutor, submits that the accusations against the petitioner are well-founded and and urged to dismiss the petition. 4. As seen from the record, after thorough investigation, the investigating officer has filed the charge sheet. The case has been registered as S.C. No.102 of 2025 and is now pending trial. The petitioner is a suspect and also a rowdy-sheet holder, vide Rowdy Sheet No. 84 of 2025. There are five adverse criminal antecedents reported against the petitioner. This is the second bail application filed by the petitioner. Accused No. 3 was enlarged on bail by the learned Trial Court, and Accused No. 4 was enlarged on bail by this Court. There is an eyewitness to the alleged offence, L.W.5 who has spoken about the complicity of the petitioner in his statement recorded under 3 Section 161 Cr.P.C. There is also CCTV footage showing that the petitioner stabbed the deceased. Accused No.3 accompanied to the scene of offence. The accused No.3 caught hold of the deceased and the petitioner stabbed the deceased. 5. Considering the gravity and nature of the allegations, as well as the facts and circumstances of the case, this Court is not inclined to enlarge the Petitioner/Accused No. 1 on bail at this stage. 6.
