1. Heard Ms. Smita Jha, learned counsel for the petitioners. Also heard Mr. Nitansh Jaiswal, learned Panel Lawyer for respondents / State.
2. The petitioners have filed CRMP No. 3755/2025 praying for following relief:-
“It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and Quash FIR dated 02.07.2023 (Annexure P/1) bearing crime no. 530/2023 for the offence under section 420,467,468,471, 201, 120B of IPC in the interest of justice.”
3. The petitioners have filed CRMP No. 2749/2025 praying for following relief:-
“It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and Quash FIR dated 02.07.2023 (Annexure P/1) bearing crime no. 530/2023 for the offence under section
3 420,467,468,471,120B of IPC in the interest of justice.”

Learned counsel for the petitioners submits that she has filed the Vakalatnama of the petitioners in the present case, which is on record.

In compliance to the Court’s order dated 03.09.2025 wherein the Superintendent of Police, Durg was directed to file his personal affidavit calling upon an explanation from the Investigating Officer concerned as to why the investigation in the present case has not yet ben concluded, despite the FIR having been registered on 02.07.2023, the Superintendent of Police, Durg has filed his affidavit stating that he has the highest regard for the lawful authority of this Hon’ble Court and its orders. He further states that, upon receipt of a complaint alleging cheating of Rs. 1.5 Crores by accused Premjeet Sharma on the pretext of investment in a solar lights project in Nepal, an FIR was registered and investigation initiated. During the course of the investigation, verification of records revealed that M/s Sungevity Enterprises Limited, having its registered office in Mumbai, had Premjeet Sharma, his wife Aishwarya Sharma, Sanjay Bharu, and Binod Kumar as its directors. The mobile location of the main accused was kept under surveillance, and police teams visited Mumbai in 2023, however, he could not be apprehended at that time. He was ultimately arrested on 21.03.2025 at Patna, Bihar, while his wife was granted anticipatory bail by this Court. Show-cause notices dated 04.09.2025 were issued to Sub-Inspector Guruvinder Singh Sindhu
4 and Assistant Sub-Inspector Babulal Sahu, the Investigating Officers at the relevant time, whose replies were found unsatisfactory. Subsequently, the Inspector General of Police, Durg, vide order dated 12.09.2025, imposed a penalty of Rs. 1,000/- each, to be entered in their service records. The Superintendent of Police, Durg has tendered an unconditional apology for the delay in completing the investigation and has assured that the investigation shall be concluded within four weeks, while ensuring due compliance with the orders of this Court.
6. Learned State counsel on the submits that charge-sheet has already been filed in the matter before the Competent Court.

Learned counsel for the petitioners prays to withdraw the present petition with liberty to file afresh challenging the charge-sheet.
8. In view of the same, as prayed by learned counsel for the petitioner, this petition is dismissed as withdrawn, with liberty to take recourse to law.
