JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “WHEREFORE, it is humbly prayed that this Hon'ble Court be pleased to allow this Memorandum of Criminal Petition by quashing the entire proceedings in S.C.883/2022 pending on the file of LV Additional City Civil & Session Judge (CCH-56), at Bengaluru, initiated against this petitioner for an offences punishable under section 143,144,148,120(b), 307,382,149 of IPC and under section 27 of Arms Act, in the interest of justice” 2. Petitioner – accused No.10, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Compromise Petition and Joint Affidavit, which reads as under:- “JOINT COMPROMISE PETITION It is respectfully submitted as follows:- That the petitioner herein is the accused No.10 in S.C.883/2022 pending on the file of LV Additional City Civil & Session Judge (CCH-56) at Bengaluru, initiated against the petitioner based on the complaint given by Respondent No.2 initiated against the petitioner for an offences punishable under section 143, 144, 148, 120(b),307,382,149 of IPC and under section 27 of Arms Act. That the Petitioner in the above case and the complainant/Respondent No.2 have compromised and settled the dispute between them on the intervention and advice of friends and well-wishers accordingly the complainant/respondent No. 2 do not wish to continue with the above case as against the petitioner in the above criminal petition as well as in S.C.883/2022 pending on the file of LV Additional City Civil & Session Judge (CCH- 56) at Bengaluru. Nagarajappa, Aged about 37 years, R/at, No.70, Hunasavadi village, Puravara Hobli, Madhugiri Taluk Tumakur District, Pin: 572175, b) Deepak @ Kalla Deepak S/o Ramanna, Aged about 45 years No. 120, 2nd Cross, Nanjappa Block, B.T.Layout, Near Bhajane Mane, K.G. Nagara, Bengaluru City Pin Code: 560025, do hereby solemnly affirm and state on oath as follows:- 1. We submit that, we are the Petitioner and Respondent No.2, in the above case, we know the facts and circumstance of the case accordingly we are swearing this Joint affidavit. 2. We submit that, based on the complaint filed by the Respondent No.2, a criminal case has been registered against the petitioner for an offences punishable under section 143,144,148,120(b), 307,382,149 of IPC and under section 27 of Arms Act, now the said case is pending in S.C.883/2022 pending on the file of LV Additional City Civil & Session Judge (CCH-56) at Bengaluru. 3. We submit that, on the intervention of friends and well-wishers matter is settled between us, accordingly the complainant/respondent No. 2 do not wish to continue with the above case as against the petitioner in the above criminal petition as well as in S.C.883/2022 pending on the - 5 - HC-KAR NC: 2025:KHC:27711 CRL.P No. 10439 of 2025 file of LV Additional City Civil & Session Judge (CCH-56) at Bengaluru. 4. In view of the settlement, we pray for quashing of the proceedings in S.C.883/2022 pending on the file of LV Additional City Civil & Session Judge (CCH-56) at Bengaluru.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Compromise Petition and Joint Affidavit dated 22.07.2025. (ii) The proceedings in S.C.No.883/2022 (arising out of Crime No.52/2021 of 1st respondent – Police) registered for the offences punishable under Sections 143, 144, 148, 120(b), 307, 382, 149 of IPC pending on the file of LV Additional City Civil & Session Judge (CCH-56), Bengaluru, insofar as the petitioner is concerned are hereby quashed.
