ORDER: Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/sole Accused on bail in Crime No. 138 of 2025 of Vedurukuppam Police Station, Chittoor District, registered against the
2 Petitioner/sole Accused herein for the offences punishable under Section 196(1)(a), 326(f) and 326 (g) of the Bharatiya Nyaya Sanhita, 2023 (for brevity . ‘theBNS’). 2. Heard the learned counsel for the petitioner and the learned /assistant Public Prosecutor. Perused the record. The allegation against the Petitioner/sole Accused is that he burnt the legs of the statue of Dr. B.R.Ambedhar. He was arrested on 30.10.2025. He has been in the judicial custody for the past 6 days. So far ten witnesses examined. They are all material witnesses. The Petitioner after his judicial remand, he was in the hospital for his treatment from 17.10.2025 to
21.10.2025. The police filed a petition before the learned Magistrate seeking for his police custody and that petition was allowed. The Petitioner was taken to police custody for one day. L.Ws.3 to 10 are the eyewitnesses. L.W.10 is the owner of the shop, which was subjected to burnt. It is not the case of the prosecution that the Petitioner caused the house of L.W.10 to burn. The police so far, have not identified who is the person/persons responsible for causing arson to the house of the L.W.10. Therefore, Section 326(g) of ‘the BNS’ at present is not applicable to the Petitioner. Section 326(g) of ‘the BNS’ is punishable up to 10 years. Section 326(f) of ‘the BNS’ mischief by fire is punishable up to 7 years. Section 196 (1)(a) of ‘the BNS’ is punishable up to 3 years. 3. are
4. The Petitioner is sarpanch of Bommayapali village. He took major steps for erection of Dr. B.R.Ambedhar statue. The Petitioner belongs to Scheduled
3 caste. L.W.10 belongs to Scheduled Caste. The learned Counsel for the Petitioner showed a video clip of L.W.10 wherein she alleged that she was beaten blue and black by the police for extracting the statement implicating the Petitioner into the case. Learned Counsel for the Petitioner submits that the Petitioner only provided financial health to the L.W.10 for the purpose of establishing the shop.
Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioner/Accused and nature of the evidence available so far, this is inclined to enlarge the Petitioner/Accused on

In the result, the Criminal Petition is allowed with the following stringent conditions: The Petitioner/Accused shall be enlarged on bail subject to he executing bond for a sum of Rs.25,000/- (Rupees twenty five thousand only), with two sureties each for the like sum each to the satisfaction of the learned Principal Junior Civil Judge Court, Puttur. I. ii. The Petitioner/Accused shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial \ Court. lii- The Petitioner/Accused shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. The Petitioner/Accused shall commission of any offence in future. The Petitioner/Accused IV. not commit or indulge in V. shall cooperate with the investigating officer in further investigation of the case and shall make himself available for i officer as and when required. The Petitioner/Accused shall make any inducement, threat interrogation by the investigating VI. not, directly or indirectly, or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any poiice officer. vii. The Petitioner/Accused shall surrender his passport, if any, to the investigating officer.
