SHAIK MOHAMMED ISMAIL Counsel for the Respondent: ---- The Court made the following ORDER: This Civil Revision Petition has been filed seeking a direction to the learned Principal District Judge, Kadapa, to dispose of IA No.1295 of 2024 in AS No.69 of 2024, as expeditiously as possible. 2. Case of the petitioner is that the respondent herein filed OS No.131 of 2015 on the file of the learned Principal Senior Civil SRK, J CRP No.3555 of 2025 2 Judge, Kadapa, against the petitioner herein for partition of suit schedule properties into two equal shares and to allot one such share to her. By judgment and decree dated 27.09.2024, learned Principal Senior Civil Judge, Kadapa, passed a preliminary decree only in respect of item No.3 of the suit schedule property and the suit in respect of item Nos.1 and 2 of the suit schedule property was dismissed. Aggrieved by the said judgment and decree, petitioner herein preferred AS No.69 of 2024 on the file of the learned Principal District Judge, Kadapa, and along with the said appeal suit, petitioner also filed IA No.1295 of 2024 praying to suspend/stay the operation of decree and judgment dated 27.09.2024 passed in OS No.131 of 2015 by the learned Principal Civil Judge (Senior Division), Kadapa, and the same is pending for adjudication. While pending the said IA, respondent herein filed IA No.219 of 2025 in OS No.131 of 2015 praying to pass final decree in terms of the preliminary decree, wherein the learned Principal Civil Judge (Senior Division), Kadapa, by an order dated 11.092025, appointed an Advocate-Commissioner to measure item No.3 of preliminary decree schedule with the assistance of Mandal Surveyor concerned and file report, on the ground that there is no stay order in AS No.69 of 2024. Hence, the petitioner prays to direct the learned Principal District Judge, SRK, J CRP No.3555 of 2025 3 Kadapa, to dispose of IA No.1295 of 2024 in AS No.69 of 2024 as expeditiously as possible. 3. In view of the aforesaid facts and circumstances, without going into the merits of the case, the learned Principal District Judge, Kadapa, is directed to dispose of IA No.1295 of 2024 in AS No.69 of 2024, in accordance with law, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. 4. With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
