Hoque, the learned counsel who appears on behalf of the respondents. 2. Both the learned counsels appearing on behalf of the parties have submitted that the matter has been amicably resolved, and as such, a joint petition has been filed before this Court. 3. Be that as it may, it is relevant to take note of that the present proceedings is taken up under Article 227 of the Constitution whereby an order dated 14.12.2015 passed under Order XXI Rule 97 and 101 of the Code of Civil Procedure, 1908 (for short, ‘the Code’) has been put to challenge. Taking into account that the order passed in a proceedings under Order XXI Rule 97 and 101 of the Code comes within the ambit of a decree in view of the specific provision of Order XXI Rule 103 of the Code, this Court would not have the jurisdiction to entertain the present proceedings. 4. Mr. A. K. Purkayastha, the learned counsel appearing on behalf of the petitioners therefore submitted that he may be Page No.# 5/5 permitted to withdraw the instant petition and taking into account that both the parties have amicably resolved the dispute, they may be permitted to file appropriate application before the learned Executing Court. 5. Taking into account the above, this Court closes the instant petition on withdrawal. 6. Liberty however is given to both the parties to file their application for compromise before the learned Executing Court. 7.
