Mr. Kakumanu Joji Amrutha Raju, the learned Counsel for the Petitioner, submits that the petitioner has not committed any offence. He is innocent. He was falsely implicated in this case. He has got fixed abode. He is the sole breadwinner of his family. He is ready to abide by any conditions if this Court deems fit to impose by enlarging the petitioner on bail and it is urged to allow the petition. 3. Per contra, Ms. Akhila Naidu, the learned Assistant Public Prosecutor, vehemently opposed to grant of bail to the petitioner contending that the investigation is at a nascent stage. So far, only three witnesses have been examined. There are four IPC cases against the petitioner, and the petitioner is a suspect sheet holder. Hence, it is urged to dismiss the petition. 4. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3 Dr.YLR,J Crl.P.No.12401 of 2025 Dated 08.12.2025 5. As seen from the record, the petitioner/Accused No.3 was spot arrested while in possession and transportation of 6.370 Kgs of ganja, of course it is not a commercial quantity. So far, only three witnesses have been examined. Some more material witnesses have to be examined. There are no similar adverse antecedents reported against him, but there are four IPC cases registered against the petitioner. The petitioner is a suspect sheet holder, but the Petitioner is presumed to be innocent until the guilt is proved. The petitioner was arrested on 10.09.2025. He has been in judicial custody for the past 88 days. The investigation is at a progressive stage. Hence, the request for grant of bail to the petitioner is not found convincing or reasonable at this juncture. 6. Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioner/Accused No.3, this Court is not inclined to grant bail to the Petitioner/Accused No.3. Hence, this Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
