GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 21153 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the in-action of the respondents in taking action on the representation/ complaint dated 02-08-2023 made by the petitioner, seeking protection from the respondents Nos. 7 to 10 as there is threat to his life from them, as illegal, arbitrary, unjust and also being violative of Art. 14 and 21 of the Constitution of India and Consequently Direct the respondents to take action on the representation / complaint dated 02-08-2023 made by the petitioner and to provide protection to the petitioner.…” 2. Heard Sri B.Vijaya Bhasker, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the respondent- police are not taking any action on the complaint made by the petitioner. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that on 09.08.2023, the SI of Police, have received the petition of the petitioner through registered post. On perusal of the contents, the allegations made are under Sections 506 r/w 34 of IPC, which is a non-cognizable offence. Therefore, the respondent police have filed a petition before the learned Additional Judicial First Class Magistrate, Nandigama to register the case under Section 506 r/w 34 of IPC vide C.F.No.3962 of 2023. After getting permission from the Court, the police have 4 registered a case in Cr.No.463 of 2023 under Section 506 r/w 34 of IPC on the file of Nandigama P.S., on the complaint of the petitioner. 5. Recording the above said submissions, this Writ Petition is disposed of. No order as to costs.
