PONNEKANTI MALLIKARJUNA RAO THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 23377/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate Writ order or direction more particularly, one in the nature of Writ of Mandamus declaring the action of the respondent 2 to 5 in calling the petitioners for settlement of the civil disputes in the DSP Office, Sattenapalli, Palnadu District as bad, illegal, arbitrary, and violative of Articles 14 and 21 of Constitution of India and consequentiy direct the official respondents not to interfere unnecessarily in the civil disputes and not to call petitioner to the police station in settling the civil dispute and pass..” 2. Heard Sri D.V.Sasidhar, learned counsel for the petitioner and Sri P.Ajay babu, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that, it is a case of interference of police in the civil disputes. 4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on instructions, would submit that based on the complaint lodged by Vandlavalli Koteswararao-8th respondent, under the Public Grievance Redressal System, the respondent police called the petitioner for enquiry. After conducting a preliminary enquiry, a case in Crime No.176 of 2024 was registered under Sections 318(4), 336(3), 340(2), 126(2), 115(2), and 351(2) read with Section 3(5) of the BNS. He would further submit that the police have never called the petitioner for settlement of the civil disputes between the parties in the DSP Office. 5. The learned counsel for the petitioner would submit that, recording the above said submissions, the court may pass appropriate orders. 6. Recording the same, this Writ Petition is disposed of. However, the police are directed to follow due process of law regarding the crime which is registered against the petitioner. No order as to costs.
