JUSTICE RAVI V HOSMANI Digitally signed by ANUSHA V Location: High Court of Karnataka - 2 - HC-KAR NC: 2025:KHC:29062 WP No. 22511 of 2025 ORAL ORDER This petition is filed seeking following reliefs: "(a) Call for records; (b) Issue a writ of mandamus directing the respondent, the Secretary, RTA Tumakuru to assign the proposed timings dated 20.02.2024 as per Annexure-B to the Stage carriage permit No.44/91-92 valid upto 05.11.2026; (c) And for any order or direction as this Hon'ble Court deems fit to pass in the interest of justice." 2. Sri M.E. Nagesha, learned counsel for petitioner submits that petitioner is an existing stage carriage operator under permit no.44/91-92 valid upto 05.11.2026 for route of Dharmapura to Murugamulla and back. And petitioner intended to change timings as it was not suitable for travelling public. Therefore, he filed an application for revision of timings on 21.02.2023 as per Annexure-A. In pursuance, respondent put- up proposal on notice board inviting objections to proposed timings from other existing operators. Thereafter, there was no progress, constraining petitioner to file this writ petition. 3. Smt.Vaheeda, learned Additional Government Advocate for respondent - State on instructions would submit if petitioner's application is pending, same would be considered in - 3 - HC-KAR NC: 2025:KHC:29062 WP No. 22511 of 2025 accordance with law and appropriate decision taken thereon within reasonable time. 4. Heard, learned counsel for parties and perused writ petition record. 5. In view of above and as pendency of application filed by petitioner at Annexure-A and proceedings for revision of timings on said application before respondent is not in dispute, writ petition is disposed of directing respondent to proceed with petitioner’s application in accordance with law from stage it is pending as on today and to take a decision thereon within a period of four weeks from date of receipt of certified copy of this order. Needless to observe that authority would be required to give opportunity of hearing to petitioner as well as rival operators in process of consideration.
