FMA 2649 of 2015 With CAN 1 of 2013 (Old No: CAN 1513 of 2013) With CAN 2 of 2013 (Old No: CAN 1514 of 2013) With CAN 3 of 2014 (Old No: CAN 12263 of 2014) With CAN 4 of 2014 (Old No: CAN 12264 of 2014) Mithu Das Vs. The State of West Bengal & Ors. Mr. Samim Ahammed, Mr. Arka Maiti, Ms. Ambiya Khatun, Md. N. Haque …. For the Appellant. Ms. Dipanjan Datta Mr. Soumen Chatterjee …. For the State.
1. The instant appeal is directed against judgment dated 17.10.2012. The learned Single Bench dismissed the writ petition on the ground that the writ petitioner has deliberately suppressed higher educational qualification for the post of Anganwadi Worker.
2. There was admittedly a disqualification against persons having higher qualifications to apply for the said post in the notice inviting application.
3. In such circumstances, the dismissal of the writ petition and the reasoning therefor in the impugned judgment cannot be faulted.
4. The State may, however, in its own and exclusive discretion, consider the case of the petitioner, if at all, for the post in question. Such request is made without creating any right or precedent, whatsoever in favour of the petitioner.
5. With the aforesaid observations, FMA 2649 of 2015 shall stand disposed of.
6. In view of the above, connected applications, if any, shall also stand disposed of.
7. There shall be no order as to costs.
8. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.) (Ajay Kumar Gupta, J.) 2
