The petitioner claims that he is entitled for promotion to Group-C. He has made a representation before the competent authority but to no avail. The only prayer made by Shri Kushagra Srivastava, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Learned Standing Counsel for the respondent No.1-State and Shri Shahrukh, learned counsel for the respondents No.2 and 3 submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that his claim for promotion to Group-C is liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent No.2- Chairman, Nagar Palika Parishad, Hapur and respondent No.3-Chief Executive Officer, Nagar Palika Parishad, Hapur/competent authority shall decide the representation of the petitioner regarding his claim for promotion to Group-C as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
