The Court:- AP-COM/323/2025 is disposed of upon directing that there shall be unconditional stay of operation of the award dated December 31, 2024 passed by the learned sole Arbitrator for a period of four weeks. Within such time, the award-debtor will deposit a sum of Rs.7 lakhs by way of a demand draft before the Learned Registrar, Original Side, High Court, Calcutta. The said amount shall be invested in an interest bearing auto- renewable short term fixed deposit with any nationalized bank. The issue raised by Mr. Chowdhury that the interest which accrued on the fixed deposit made by the respondent pursuant to an order of a co- ordinate Bench on an application under Section 9 of the Arbitration and Conciliation Act, 1996 was to be enjoyed by the award holder, will be decided at the time of execution. 2 If the deposit as directed above is made, the stay shall continue till disposal of the application under Section 34 of the Arbitration and Conciliation Act, 1996.
