CORAM:
HON'BLE MS. JUSTICE MADHU JAIN O R D E R % 22.07.2026
1. This hearing has been done through hybrid mode.
2.
Learned counsel for the respondents submits that the petitioner and his family are natives of Jalandhar and that it is the petitioner's modus operandi to project himself as an unmarried man, lure women into a relationship, and thereafter dupe them of their hard-earned money. It is submitted that, in the present case, the complainant/prosecutrix was cheated of approximately ₹1.17 crores.
3.
Learned counsel for the respondents further submits that the complainant came to know about the petitioner's marriage upon receiving a legal notice issued by the petitioner's wife.
4. Learned APP for the State has handed over a Status Report. Along with the same, a copy of the marriage certificate of the petitioner with one Ms. Approva Sharma has also been placed on record, reflecting the date of This is a digitally signed order. marriage as 11.04.2022.
5. Vide order dated 02.04.2026, this Court had directed the petitioner to appear in person, as he had stated in his affidavit that he had never been convicted by any court in India or abroad. This assertion was disputed by the
learned counsel for the respondent, who submitted that the petitioner had also been convicted by a court in Dubai, directed to be deported, and was accordingly deported by the Government of Dubai after the imposition of a fine of Dirham 38,000/-.
6. Learned APP further submits that proceedings for declaring the petitioner a proclaimed offender have already been initiated before the learned Trial Court.
7. Although the petitioner filed an affidavit stating that he had never been convicted by any other court, his subsequent conduct belies the said assertion. Despite the directions of this Court, he neither appeared before the Court nor complied with its orders. Prima facie, it appears that the petitioner attempted to mislead the Court by filing a false affidavit.
8. The grant of anticipatory bail is a discretionary relief. A person seeking such discretionary relief is expected to approach the Court with clean hands. Considering the conduct of the petitioner and the nature of the allegations against him, no ground for grant of anticipatory bail is made out. The application is, accordingly, dismissed.
9. The order be uploaded on the website forthwith.
