Heard learned counsel for the petitioner as well as learned Standing Counsel. 2. Petitioner who is seeking promotion from the post of Head Constable to Sub-Inspector has come before this Court with the prayer that the sealed envelope may be permitted to be opened in the light of provisions contained under the Government Order dated 28.05.1997 read with 09.01.2018. 3. It is argued by learned Senior Advocate appearing for the petitioner that the sealed cover procedure was adopted in the matter of petitioner on 29.02.2024 on account of pending criminal case in connection with case crime no. 311 of 2023 instituted in the year 2023 which resulted in filing of charge sheet by the police in the year 2024. It is submitted that the trial is going on and petitioner in any circumstances is not responsible for the delayed criminal proceedings and therefore, his representation is liable to be considered in the light of provisions as contained in para 10 of the Government Order (supra). Para 10 of the Government Order is reproduced hereunder: "(10) चयन सममिमति दद्वारद्वा प्रथमि बद्वार आररोमपिति कद्वाममिरक ककी प्ररोन्नमति पिर मविचद्वार करनने एविव मिमुहर बन्द ललिफद्वाफने ककी प्रमक्रियद्वा अपिनद्वायने जद्वानने कने बद्वाद एक विरर ककी अविलधि बबीति जद्वानने पिर भबी इस अविलधि मिम ऐसबी अविलधि आगमणिति नहहीं ककी जद्वायनेगबी लजसमिम अपिचद्वारबी कद्वाममिरक दद्वारद्वा अविध्यद्वान कने कद्वारणि जद्वाजाँच प्रमक्रियद्वा मिम मविलिम्ब हहआ। यमद आररोमपिति कद्वाममिरक कने मविरय मिम प्रशद्वासनद्वालधिकरणि ककी जद्वाजाँच मविभद्वागबीय कद्वायरविद्वाहबी/अमभयरोजन कद्वा अनन्तिमि पिररणिद्वामि प्रद्वाप्त न हहआ हरो, तिरो ऐसने कद्वाममिरककों कने मविरय मिम , जरो मनलिनम्बति नहहीं हह / चयन सममिमति दद्वारद्वा मनम्नललिलखिति प्रमतिबन्धिकों कने सद्वाथ तिदथर आधिद्वार पिर प्ररोन्नमति कने सम्बन्धि मिम मविचद्वार मकयद्वा जद्वायनेगद्वा। (क) आररोमपिति कद्वाममिरक कने मविरूद्ध लिगद्वायने गयने आररोपि क्यद्वा इतिनने गम्भबीर हह मक उनकने आधिद्वार पिर उसने भमविष्य मिम भबी प्ररोन्नमति सने विवमचति रखिद्वा जद्वानद्वा उपियमुक/जनमहति मिम हरोगद्वा। (खि) क्यद्वा प्रशद्वासनद्वालधिकरणि ककी जद्वाजाँच/मविभद्वागबीय कद्वायरविद्वाहबी अमभयरोजन कने अनन्तिमि पिररणिद्वामि प्रद्वाप्त हरोनने मिम कद्वाफकी समिय लिगनेगद्वा। (ग) प्रशद्वासलधिकरणि ककी जद्वाजाँच/मविभद्वागबीय कद्वायरविद्वाहबी अमभयरोजन मिम हरो रहने मविलिम्ब कने ललिए प्रत्यक्ष यद्वा पिररोक्ष रूपि सने आररोमपिति कद्वाममिरक तिरो दरोरबी नहहीं हह। (घ) आररोमपिति कद्वाममिरक करो तिदथर प्ररोन्नमति मदयने जद्वानने पिर विह अपिनने पिद कद्वा दमुरूपियरोग अथविद्वा जद्वाजाँच करो कमु प्रभद्वामविति तिरो नहहीं करनेगद्वा। (ड) यमद सक्षमि प्रद्वालधिकद्वारबी उपिररोक खिण्ड (क) (खि) (ग) (घ) कने आधिद्वार पिर मविचद्वाररोपिरद्वान्ति आररोमपिति कद्वाममिरककों ककी तिदथर आधिद्वार पिर प्ररोन्नति करनद्वा उपियमुक समिझतिने हह तिरो उस दशद्वा मिम मविभद्वागबीय चयन सममिमति कने सद्वामिनने मिद्वामिलिने करो रखिद्वा जद्वायनेगद्वा जरो आररोमपिति कद्वाममिरक कने सम्पिपूणिर अमभलिनेखिकों कने आधिद्वार पिर उसकने कद्वायरव कद्वा मिपूल्यद्वाकन करनेगबी तिथद्वा तिदथर रूपि सने प्ररोन्नमति दनेनने कने अथविद्वा न दनेनने कने मविरय मिम अपिनबी सवस्तिमुमति दनेगबी। (च) यमद जद्वाजाँच प्रशद्वासनद्वालधिकरणि अद्वामद मकसबी अन्य एजनेन्सबी दद्वारद्वा करद्वाई जद्वा रहबी हरो तिरो उस दशद्वा मिम उस एजनेन्सबी कद्वा पिरद्वामिशर भबी इस मबन्दमु तिदथर आधिद्वार पिर प्ररोन्नमति दनेनने पिर प्रद्वाप्त मकयद्वा जद्वायनेगद्वा। (छ) उपिररोक प्रमक्रियद्वा कने उपिरद्वान्ति आररोमपिति कद्वाममिरक कद्वा तिदथर रूपि सने प्ररोन्नमति मकयने जद्वानने कने आदनेशकों मिम यह स्पिष्ट मकयद्वा जद्वायनेगद्वा मक प्ररोन्नमति अमग्रिमि आदनेशकों तिक कने ललिए ककी जद्वातिबी हह और शद्वासन करो उक तिदथर प्ररोन्नमति करो कभबी भबी समिद्वाप्त कर दनेनने कद्वा अलधिकद्वार हह तिथद्वा तिदनमुसद्वार ऐसने कद्वाममिरक करो उस पिद पिर प्रत्यद्वाविमतिरति मकयद्वा जद्वा सकतिद्वा हह लजस पिद सने उसने प्ररोन्नति मकयद्वा गयद्वा थद्वा। (ज) तिदथर आधिद्वार पिर प्ररोन्नति आररोमपिति कद्वाममिरक कने मविरूद्ध चलि रहबी प्रशद्वासनद्वालधिकरणि ककी जद्वाजाँच/मविभद्वागबीय कद्वायरविद्वाहबी अमभयरोजन आमद कने अनन्तिमि पिररणिद्वामि प्रद्वाप्त हरो जद्वानने पिर उसकने मविरय मिम उसबी प्रकद्वार अमग्रिमि कद्वायरविद्वाहबी ककी जद्वायनेगबी , जहसबी ककी जद्वातिबी हह यमद उसने तिदथर प्ररोन्नमति न दबी गयबी हरोतिबी। (झ) यमद न्यद्वायद्वालिय दद्वारद्वा मकसबी तिदथर रूपि सने प्ररोन्नति कद्वाममिरक करो तिकनबीककी आधिद्वार पिर (गमुणिद्वाविगमुणि कने आधिद्वार पिर नहबी) दरोरमिमुक मकयद्वा जद्वातिद्वा हह और न्यद्वायद्वालिय कने मनणिरय कने मविरूद्ध अपिबीलि यद्वा उसबी आररोपि कने ललिए मविभद्वागबीय कद्वायरविद्वाहबी कद्वा प्रस्तिद्वावि हह तिरो उस दशद्वा मिम समिक्ष प्रद्वालधिकद्वारबी इस मबन्दमु पिर मविचद्वार करमगने मक आररोमपिति कद्वाममिरक करो तिदथर प्ररोन्नमति पिर बनद्वायने रखिद्वा जद्वाय अथविद्वा नहहीं।" 4. Learned counsel for the petitioner submits that in the above regard, petitioner has already approached the authority on 13.03.2024 by making a representation, copy whereof has been brought as Annexure No. 10 to the writ petition. 5. Learned Standing Counsel submits that the matter can be directed to be examined in the light of provisions as contained in para 10 of the Government Order by the competent authority in the matter which has been represented with. 6. In view of the above, this petition stands disposed of with a direction to the competent authority to look into and consider the representation of the petitioner in the light of provisions as contained in para 10 of the Government Order and pass appropriate, reasoned and speaking order within a period of two months of presentation of certified copy of this order. It is further provided that in the event respondents comes to conclude that the petitioner is entitled to benefit of reopening of the sealed envelop, the same shall be reopened and petitioner be offered ad hoc appointment subject to the conclusion of trial and be paid salary accordingly.
