(The Accused Petitioner Is In Judicial Custody In District Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Abhijeet Panchariya For Respondent(s) For Complainant : : Mr. Jaiprakash Tiwari, PP Mr. Purushottam Sharma HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 21/04/2025 1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.153/2024 registered at Police Station-Niwai, District-Tonk for the offences under Sections 143, 323, 308, 452 and 504 IPC. Since both the bail applications have [2025:RJ-JP:16737] (2 of 3) [CRLMB-1677/2025] arisen from common order, hence, they are being decided by this single order. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners has made the submission that the main accused Hanuman has been enlarged on bail by Coordinate Bench of this Court on 27.01.2025. The petitioners are behind the bars since 17.03.2024. Charge-sheet has been filed. Moreover, the civil litigations are pending between the parties. The main accused has been granted bail. The trial of the case may take considerable time, hence the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor as well as counsel for the complainant have vehemently opposed the bail application and stated that they made a complaint against Hanuman for threatening the witnesses on which a complaint under Sections 156 and 135 of BNSS has been registered. Looking to the gravity of the offence, the petitioners are not entitled for bail. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Omprakash @ Pappu S/o Jagdish and Sitaram S/o Jagdish shall be released [2025:RJ-JP:16737] (3 of 3) [CRLMB-1677/2025] on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
