ORDER:
The instant Criminal Petition under Section 528 Bharatiya Nagarik Suraksha Sanhita Act, 2023(for short ‘BNSS act’) has been filed, by the petitioner/accused Nos.1 to 4, seeking to quash the proceedings against them in Cr. No. 161/2025 of Cyber Crime Police Station, Visakhapatnam Commissionerate.
2. I.A.No.2 of 2025 is filed by the 1st respondent/de-facto complainant, seeking to compromise the matter in Cr. No. 161/2025 of Cyber Crime Police Station, Visakhapatnam Commissionerate, by recording compromise.
3. I.A.No.3 of 2025 is filed by the 1st respondent/de-facto complainant, seeking to compromise the case with the Respondents/A.1 to A.4 in Cr.No.161/2025 of Cyber Crime Police Station, Visakhapatnam Commissionerate.
4. The petitioner/accused Nos.1 to 4 and respondent No. 1/de-facto complainant were present before this Court. They produced their respective attested copies of Aadhar cards in proof of their identity, and the same were placed on record for proper identification. Both the learned counsel on record identified both the parties in open Court.
5. When the matter was taken up for hearing, the learned Assistant Public Prosecutor, Ms. K. Priyanka Lakshmi, opposed recording of the

compromise on the ground that there may be several victims involved in the case and therefore the compromise cannot be accepted at this stage.
6. Learned counsel for the 1st respondent/de-facto complainant submitted that she intends to withdraw the complaint against the petitioners and seeks liberty to withdraw the same, since the matter is still under investigation.
7. Considering the submissions of both sides, the Criminal Petition is disposed of. The 1st respondent/de-facto complainant is at liberty to withdraw her complaint since the matter is pending investigation. This order does not preclude the police to take action against the petitioner upon receipt of complaint from any other victims.
As a sequel, thereto, miscellaneous pending applications, if any, shall stand closed.
