The Court made the following: THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CIVIL REVISION PETITION NO: 1035/2025 ORDER 1. This civil revision petition is filed questioning the inaction on the part of the Judicial First Class Magistrate for Special Mobile Court. Kadapa in not disposing of the suit in O.S.No.583 of 2021, which is filed for issuance of family member certificate in favour of plaintiffs/petitioners. 2. It is the case of the petitioners that the petitioners 1 and 3 are the sisters and the petitioner No.2 is the brother of one Veparala Baby Kala Rani, who was unmarried and died on 30.11.2018, due to Cancer, while working as Superintendent at Hon’ble Family Court, Kadapa. The petitioners and their mother Saramma and another sister by name Santhamma performed her last rites and performed all her death ceremonies at their house in Kadapa. While so, on 07.12.2018 their mother Saramma applied family member certificate of the said Veparala Baby Kala Rani, for and on behalf of petitioners and Santhamma being one of legal heirs of deceased to the 2^^ respondent along with the copies of required documents, then the defendant authorities rejected the same stating that documents were not submitted, though at the time of submitting application, they have enclosed all the said required documents and the same had been verified by the 3'^^ defendant at the time of his visit. While things stood thus, the mother of petitioners/ plaintiffs i.e., Saramma and another sister of petitioners/plain tiffs i.e., Santhamma died on 24.04.2021 due to old age. Thus, the petitioners/plaintiffs became the legal heirs of Veparala Baby Kala Rani and brought the same to the notice of the defendants/ respondents 2 and 3 and requested them to verify all the documents and issue family member certificate of their sister Veparala Baby Kala Rani in their names being her legal heirs and enable them to claim her death benefits and other employment benefits etc., as she died in service, but the defendants did not consider their representation. Hence, they instituted a suit in O.S.No.583 of 2021 before the Principal Junior Civil Judge, Kadapa. Though the suit was numbered on 16.06.2021, till this date, the same was not disposed of. Hence, this petition. 3. Heard both sides. 4. Right to expeditious trial is a right guaranteed under Article 21 of the Constitution of India and failure to dispose of the suit causing much delay at the cost of the parties would amount to denial of speedy trial. Therefore, the Judicial First Class Magistrate for Special Mobile Court, Kadapa, is directed to dispose of the suit in O.S.No.583 of 2021, in accordance with law, within nine (09) months from the date of receipt of a copy of this order. 5. In the result, civil revision petition is disposed of. No costs. 6. Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
