This is a misconceived appeal. The same appellant had earlier filed Special Appeal Defective No. 488 of 2024 which was dismissed as withdrawn on 25.06.2024. No liberty was granted to the appellant to file afresh special appeal. In such view of the matter, objection raised by the respondents that a second intra-court appeal (Special Appeal) on the same cause would clearly be hit by Chapter XXII, Rule 7 of the High Court Rules, 1952 merits acceptance.
