This is an application under Section 483 of the BNSS 2023, whereby the petitioner, Apurba Gogoi has prayed for releasing him on bail as he is facing trial in connection with PRC Case No. 748/2024 (arising out of Barbaruah PS Page No.# 2/2 Case No.70/2024) pending in the court of learned CJM, Dibrugarh. The petitioner has been charge sheeted in the case under Section 326/307 of IPC. In total, seven persons were shown as prosecution witnesses and the list includes the medical officer and the police investigating officer. Charge sheet has been filed within time. Trial is yet to begin. This court is of the opinion that at this stage, the petitioner do not deserved to be released on bail. His bail application shall be considered again after examination of the four witnesses including the victim girl. With the aforesaid directions, bail application stands closed.
