The Chief Judicial Magistrate, Shahjahanpur vide his letter dated 16.1.2025 has informed to this Court that accused-respondent No.1 namely, Raghu Nath Singh alias Tulli has passed away about 15 years back while accused-respondent No.2 namely Shyam Bahadur Singh alias Sakroo, has passed away about six months back. In verification to their death, statements of one Bhanu Pratap s\o Raghu Nath Singh and Vikash, s\o Shyam Bahadur Singh has been recorded. The statement of sub- inspector Sukendra Pal Singh, Police Station- Tilhar, District- Shahjahanpur has also been recorded. In view of the aforesaid fact that since both the accused-respondents have passed away, as such the instant government appeal be dismissed as having been abated. 2. Learned A.G.A. for the State-respondents could not dispute the aforesaid facts. 3. In view thereof, the instant government appeal stands dismissed as abated.
