Neutral Citation No. - 2025:AHC:78470 Court No. - 32 Case :- WRIT - C No. - 14979 of 2025 Petitioner :- Committee Of Management Gajraj Singh Ramkali Smarak Inter College Mohammadabad And Another Respondent :- State Of Up And 6 Others Counsel for Petitioner :- Mayank Pranjal,Parmendar Singh Counsel for Respondent :- C.S.C. Hon'ble Saral Srivastava,J. 1. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The petitioner by means of present writ petition has prayed for following relief: "To issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to see that four rooms of the institution namely Gajraj Singh Ramkali Smarak Inter College Mohammadabad, District Farrukhabad, which have been illegally occupied by the respondent no.7 may be vacated within short stipulated period to be fixed by this Hon'ble Court so that the educational environment in the institution namely Gajraj Singh Ramkali Smarak Inter College Mohammadabad, district Farrukhabad, may be brought to normal situation;" 3. Earlier also the petitioner approached this Court by filing Writ-A No.16714 of 2019 in which this Court passed the following order: "The institution in question is not an aided institution and is run by a private Committee of Management. The Committee of Management has come to this Court raising a grievance that in a dispute with the Principal, the Principal acting illegally has locked four class rooms in which important documents have kept and the petitioner through the D.I.O.S. have made complaint to the Superintendent of Police where no action has been taken. In case such a complaint is pending before respondent no. 5 or respondent no. 6, follow up action is expected from them. With the aforesaid observation, the writ petition is disposed of." 4. The petitioner thereafter preferred Contempt Application (Civil) No.5442 of 2020. It was disposed off by this Court. It appears that for the same relief the petitioner approached this Court again. 5. The law is settled that the second writ petition for the same relief is not maintainable and in such view of the fact, the relief prayed for cannot be granted. 6. Consequently, the writ petition is dismissed with liberty to the petitioner to avail appropriate remedy, if so advised, available under the law.
