PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.1 for granting of pre-arrest bail in connection with Crime No.498 of 2025 of Muvvanipalem Police Station, Visakhapatnam Commissionerate, registered for the alleged offence punishable under ^ 2 Sections 406, 420 read with 34 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C’). 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. Learned Assistant Public Prosecutor submits that offences with which the Petitioner has been arraigned are all punishable below seven years of imprisonment. Therefore, the Investigating Officer would follow the provisions of under Section 35(3) of ‘the BNSV41-A of ‘the Cr.P.C.,’ and also directions issued in the cases of Arnesh Kumar v. State of Blhar^ and Md.Asfak Alam v. the State of Jharkhand^. Nevertheless, a learned Single Judge of this Court in Crl.P.No.12098 of 2025 granted the relief to the wife of the Petitioner, who was arraigned Accused No.2 that the police should not take any coercive steps against Accused No.2. 4. as The Hon’ble Apex Court in Delhi Race Club (1940) Ltd v. State of Uttar Pradesh^ and also in Arshad Neyaz Khan v. State of Jharkhand"^, observed that the criminal breach of trust and cheating cannot go together. 5. Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioner/Accused No.1, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.1. 6. In the result, the Criminal Petition is allowed with the following conditions; In the event of arrest of the Petitioner/Accused No.1, he shall be enlarged on bail subject to he executing a self-bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials. The Petitioner/Accused No.1 shall make himself available for investigation as and when required. The Petitioner/Accused No.1 shall not cause any threat, inducement or promise to the prosecution witnesses. The Petitioner/Accused No.1 shall surrender his passport, if any, to the investigating officer.
