This appeal is of the year 1984 and the matter has been taken up in the revised list which has been listed under the caption of oldest pending cases in the High Court, for priority hearing but nobody is present on behalf of the appellants. Though the name of Sri Birendra Singh and Ram Swarup Tewari, learned counsels for the appellant is shown in the cause list. The appeal is against the judgment and order dated 05.09.1984 passed by Special Judge (DAA) Banda in S.T. No. 305 of 1981 convicting the appellant to undergo rigorous imprisonment of four years under section 399, 402 IPC. There is an office report dated 10.07.2025 shows that the appellant Ram Pratap S/o Devi Din has expired. Appendix-A is the communication dated 25.04.2022 of the CJM, Banda addressed to the Section Officer, Criminal Appeal section mentioning therein that two years ago from the date of the communication, the sole appellant expired.
