GP FOR LAND ACQUISITION (AP) NJS,J W.P No.11915 of 2018 3 The Court made the following Order: The present writ petition is filed seeking to declare the inaction on the part of the respondent Nos.1 to 7 on the petitioner’s representation dated 13.11.2017 submitted to delete the names of the respondent Nos.8 to 10 and record the names of the petitioners pursuant to the notification dated 27.09.2017 for acquisition of the lands for the purpose of Chintlapudi Lift Irrigation Scheme in respect to the subject matter lands of an extent of Ac.0.48 cents out of Ac.1.10 cents, Ac.1.10 cents and Ac.0.72 cents out of Ac.1.10 cents respectively covered by Survey Nos.1/1C1/2, 1/1C1/3 and 1/1C1/5B respectively of Jillellagudem Village as illegal, arbitrary, etc., and pay compensation and other benefits under the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and for other reliefs. 2. Heard Ms. P Satya Haritha, learned counsel representing the learned counsel for the petitioner. Also heard Mr. D Dravidu, learned Assistant Government Pleader for Social Welfare representing the respondent No.1. 3. The learned counsel representing the petitioners submits that though several contentions were raised in the writ petition, in the light of the counter- affidavit filed by the respondent No.7, the writ petition may be disposed of by passing appropriate orders. 4. The learned Assistant Government Pleader, has drawn the attention of this Court to the relevant averments in the counter-affidavit, wherein it is specifically asserted as follows:- “4(e). The award was approved by the Spl.Collector(LA), PIP, Rajamahendravarm, vide Ref.No.C1/535/2017, Dt.16.11.2019, for the land published in Declaration only, in which the land of the present Writ Petitioner is not acquired. Hence, the question of acquiring the land belonging to the writ petitioner does not arise. NJS,J W.P No.11915 of 2018 4 9. ....the land belonging to the petitioner as specified in the petitioners affidavit was not acquired. Hence, payment of compensation and rehabilitation benefits does not arise...” 5. In view of the above stated position, this Writ Petition is disposed of, providing that in the event, the subject matter lands are required for any public purpose, the respondent authorities shall follow the due procedure as contemplated under law.
