This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.496/2025 registered at Police Station Kota, District Bilaspur (C.G.) for the offence punishable under Section 296, 115(2), 351(2), 119(1), 326(f), 309(4), 3(5) of B.N.S. Case of the prosecution, in brief, is that on 19.05.25 the complainant namely Aditya Soni along with his friends were returning from Kota Court in two separate motorcycles as they reached near Laripara Arpa Pool at that time one motorcycle of friend skipped at that time, the accused namely Abhilash Sahu reached the spot along with two friends and assaulted the complainant and his friend thereafter set on fire of motorcycle bearing No.CG-10A/2674 due to which complainant has lodged FIR before P.S. Kota District Bilaspur against Abhilash Sahu. On the basis of memorandum of Abhilash Sahu the present applicant has been implicated in this case. 3. Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application of the applicant was rejected by this Court on merits vide order dated 10/07/2025 in MCRC No.5357/2025. He would submit that trial is in progress and is at the verge of its completion and only two prosecution witnesses are left to be examined, the applicant is in jail since 25/05/2025, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that this is the second 3 bail application of the applicant and the first bail application of the applicant was rejected by this Court on merits vide order dated 10/07/2025 in MCRC No.5357/2025. Considering the fact that trial is in progress and is at the verge of its completion and only two prosecution witnesses are left to be examined, therefore this court is not inclined to entertain this second bail application. 7. Accordingly, the second bail application of the applicant- Manmohan Sahu, involved in Crime No.496/2025 registered at Police Station Kota, District Bilaspur (C.G.) for the offence punishable under Section 296, 115(2), 351(2), 119(1), 326(f), 309(4), 3(5) of B.N.S., is rejected. 8.
