ORAL ORDER
This petition is filed by the petitioner -accused No.2 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.125/2025 of Tilakanagar of Police Station registered for offences punishable under Sections 80, 85, 3(5) of BNS, 2023.
2. Heard learned counsel for the petitioner and leaned High Court Government Pleader for the respondent –State.

Learned counsel for the petitioner would contend that the petitioner -accused No.2 is brother of accused No.1. Wife of accused No.1 namely Jayashree committed suicide. It is alleged that accused No.1 was harassing the deceased demanding dowry and this petitioner -accused No.2 was residing with accused No.1 and was instigating accused No.1 to harass the deceased.

She further submits that accused No.1 has been granted bail by this Court in Criminal Petition No.13604/2025 by
order dated 27.10.2025. Therefore, this petitioner is also entitled for grant of anticipatory bail on the ground of parity. With this she prayed to allow the petition.
4. Per contra, learned High Court Government Pleader for the respondent –State would contend that charge sheet materials show prima facie case against the petitioner for offences alleged against him. The petitioner is remaining absconding. With this, she prayed for rejection of the petition.
5. Having heard learned counsels, this Court has perused charge sheet and other materials placed on record.
6. The marriage of accused No.1 with the deceased has taken place on 26.12.2024. The deceased and accused No.1 were in love affair prior to their marriage. Both families have agreed and performed the marriage of the deceased with accused No.1. The

allegation against the accused persons is that they were insisting the deceased to bring money of Rs.1,50,000/- for payment of loan borrowed on agricultural land and were harassing the deceased. Prior to deceased committing suicide, the deceased had not filed any complaint against the petitioner and his family members regarding their assault and demanding to bring money from her parents. The deceased has not left any suicide note. The only allegation against this petitioner is that he was instigating accused No.1 to harass the deceased. Accused No.1 has been granted bail by this Court. Therefore, the petitioner is entitled for grant of anticipatory bail on the ground of parity. Considering all these aspects, the petitioner has made out case for grant of anticipatory bail with conditions.

ORDER i) The petition is allowed.

ii) The petitioner is ordered to be released on bail in the event of his arrest in Crime No.125/2025 of Thilakanagara Police Station subject to following conditions. a) The petitioner –accused No.2 shall appear before the jurisdictional court within 15 days from this day and execute a bail bond for a sum of Rs.1,00,000/- with one surety to the satisfaction of the jurisdictional Court. b) The petitioner –accused No.2 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.2 shall appear before the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
