Applicant has filed this application under Section 447 B.N.S.S. seeking transfer of Sessions Case No. 1461 of 2023, titled State Vs. Vipin Kumar and others, arising out of Case Crime No. 417 of 2022, under Sections 498-A, 304-B, 504, 506, 120-B I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Khajni, District Gorakhpur, pending before the Additional District Judge, Gorakhpur to the court of competent jurisdiction at Sant Kabir Nagar. Applicant apprehends that the accused may cause harm to the complainant on appearance before the trial court, but in the considered opinion of this Court, the said apprehension is not supported with any material. Concededly, the accused are on bail and no ground regarding misuse of concession has been made by the complainant-applicant. In view of above, no case is made out for transfer of the case. The application fails and is hereby dismissed.
