By the present writ petition, the petitioner is seeking a direction towards the respondents not to make any construction on the land of the petitioner which is khara No. 349/1 area 0.320 hect. 574/1 area 0.3280 hect, 575/1 area 0.2510, 335/9 area 0.412 hect , situated in Gram Jagdishpur, Patwari Halka No. 25, Tahsil Ambikapur, District Sarguja C.G. 3 / 3 2. At the very outset, learned counsel for the parties by referring to para 6 of the reply of the State wherein it has been categorically stated that the respondents authorities have carried out necessary steps for acquisition of the said land and till now no construction is made. 3. I have heard learned counsel for the parties and perused the reply of the state. 4. Para 6 of the reply of the State reads as under:- “It is respectfully submitted by the answering respondents the aforesaid road is proposed to be constructed for the public at large and in order to provide approach for Airport to the people of the area. It is submitted that, the respondent authorities have carried out necessary proceeding to acquire private land of the petitioners and as of now no construction work has been carried out nor the land of the petitioners have been taken into possession by the respondent authorities.” 5. In view of the submission made by the learned counsel for the parties and the reply submitted by the Sate in para 6, nothing remains in this petition to adjudicate at this juncture, therefore, the petition is disposed off.
