***** O R D E R This Writ Petition has been filed challenging the impugned orders dated 10.06.2019, 03.09.2021, 28.08.2023 and 24.01.2024. 2. 3. The learned Additional Government Pleader appearing for the respondents would submit that the proper remedy for the petitioner is to approach the Labour Court. It is true that whenever any fundamental rights have been violated, the individuals are well within their right to approach the Writ Court for any remedy. He would further submit that the grievance urged by the learned counsel for the petitioner is covered by the 12(3) settlement entered into between the Management and the Union. 4. I have given my anxious consideration to the submissions made on either side. 5. In the case on hand, the only grievance raised by the learned counsel for the petitioner is that no proper enquiry was conducted, and that there is no provision in the Standing Order to frame charges against the petitioner.
In order to adjudicate upon the above contention, I need to go into the factual position of either party, which the Writ Court cannot go into. Apart from that, as rightly contended by the learned Additional Government Pleader, there is an alternative remedy available to the petitioner to approach the Labour Court. 6. In view of the above submission, this Court finds no merit in the present Writ Petition. Accordingly, this Writ Petition is dismissed. However, the petitioner is given liberty to approach the appropriate forum in accordance with law. Consequently, the connected Miscellaneous Petition is closed. No costs. 06.06.2025
