C.MIS NO.14/2016 PASSED BY BEFORE LOK ADALATH JUDICIAL CONCILATOR 1 VIDE ANNEXURE-A, ETC. THIS PETITION, COMING ON FOR DISMISSAL, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE SMT. JUSTICE LALITHA KANNEGANTI ORAL ORDER The present Writ Petition is filed seeking the following prayer: a) Issue a Writ of Certiorari, quashing the order dated 30.06.2018 in case No.C.Misc.No.14/2016 passed by before Lok Adalath Judicial Concilator.1 vide Annexure-A. b) Consequently, direct the Respondent to provide arrears from the date of filing of the petition i.e., 11.01.2016 and revise the maintenance order dated 18.08.2016 in case - 3 - HC-KAR NC: 2025:KHC:29436 WP No. 24439 of 2024 No.C.Misc.No.14/2016 passed by before by the Additional Civil Judge & JMFC at Doddaballapura (Annexure-A1) by increasing the monthly maintenance amount to Rs.35000/- to adequately meet petitioner No.1 needs; and c) Grant such other relief as this Hon'ble Court deems fit to grant in the circumstances of the case, in the interest of justice and equity. 2. It is submitted that a Lok-Adalat award is passed on 30.06.2018 whereby the parties have submitted that the case is compromised and file a joint memo reporting the same. Hence, in view of the compromise between the parties, the petition is dismissed as compromised before the Lok-Adalat. 3. Learned counsel appearing for the petitioner submits that when the matter is compromised, the husband has not adhered to the conditions in the joint memo. Hence, they have questioned this before this Court. Against an award that is passed by the Lok-Adalat, the Writ Petition can be filed before this Court only on the grounds of fraud and coercion and on any other ground, the same cannot be questioned before this Court. Parties to the compromise, if they are not honoring the - 4 - HC-KAR NC: 2025:KHC:29436 WP No. 24439 of 2024 terms of the compromise that cannot be a reason for this Court to interfere with the award. Hence, this Court finds no reasons to pass any orders in this Writ Petition. However, whatever the remedies that are available to the petitioner, the petitioner is at liberty to pursue the same.
