Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioner no.1 was in love with deceased Saurav Singh. It is next submitted that petitioner no.2 being the father of petitioner no.1 has abetted the commission of suicide of the deceased. It is further submitted that the allegation against the petitioners is false. It is then submitted that petitioners have no knowledge and information about the suicide of the victim. It is also submitted that petitioner no.1 is the Teacher in St. Anna School, Kaitha and in fact deceased always used harass her since last two years. It is then submitted that petitioner no.1 had refused to talk to the deceased on several occasions but the deceased compelled the petitioner no.1 again and again to talk to him. It is next submitted that there is no chance of petitioners absconding or tampering with the evidence. It is further submitted that the petitioners undertake that they will not annoy or disturb the informant in any manner during the pendency of the case. It is lastly submitted that the petitioners undertake to co-operate with the investigation
of the case and to furnish sufficient security including cash security. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail. Learned Addl. P.P. and learned counsel for the informant have vehemently opposes the prayer for grant of anticipatory bail and submit that petitioner no.1 was on video call for 1 hour 43 minutes at about 8.30 PM on the alleged night of occurrence and the deceased committed suicide while he was on video call. It is next submitted that petitioner no.1 had taken Rs.1,50,000/- from the deceased and she use to blackmail the deceased and even though the petitioner no.1 was in talking terms and knowing the sister of the deceased as well as his close neighbours; yet she did not disclose about commission of suicide by the deceased, to anybody. It is further submitted that the petitioner no.1, when the occurrence took place in spite of calling the sister of the deceased on her phone, she sent a message in the Facebook messenger at about 10.15 PM it is urgent to call her.
It is next submitted that petitioner no.1 at the instance of the petitioner no.2 a few years back has made complain to the police against the deceased but later on withdreaw the same after extorting money; hence the petitioner ought not be given the privilege of anticipatory bail. Having heard the submissions made at the bar and going through the materials available on record, it is admitted case of the informant that petitioner no.1 was trying her level best resisting the advances made by the deceased and even approached the police on earlier occasion also but even then the deceased persisting to have relationship with the petitioner no.1. The cold attitude of the petitioner no.1 towards the advances of the deceased; was long term and there is no material to show any specific provocation given by the petitioners for commission of suicide of the deceased. Under such circumstances, this court is of the considered view that this is fit case where the abovenamed petitioners be given the privileges of anticipatory bail. Hence, in the event of their arrest or surrender within a period of six weeks from the date of this order, they shall be released on bail on depositing Rs.10,000/- each as cash security and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ramgarh, in connection with Ramgarh P.S.
