CORAM: HON'BLE MR. JUSTICE S SUNIL DUTT YADAV ORAL ORDER The present petition has been filed seeking to set aside the notice dated 28.10.2025 issued under Section 104 of the Karnataka Land Revenue Act at Annexure-A. The said notice directs the petitioner to evict and hand over vacant possession.
2. The petitioner submits that, as averred in this petition though proceedings have progressed, as regards his application for regularisation and till the decision is taken, the impugned

HC-KAR NC: 2025:KHC:47456 WP No. 34741 of 2025 notice at Annexure-A issued is premature, illegal and without authority of law.
3. Learned Additional Government Advocate furnishes copy of the proceedings of the Deputy Commissioner dated 18.07.2023 which would indicate that the claim of the petitioner has been rejected on the ground that the land, regularisation of which is sought is "Gundu Thopu".
4. Learned counsel for petitioner submits that the said
order was not communicated to him and it is for the first time that he has been made aware of the said order.
5. Taking note of the said assertion of the petitioner, it would be appropriate to grant liberty to the petitioner to challenge the order of the Deputy Commissioner dated
18.07.2023.
6. In light of specific assertion that the order of the Deputy Commissioner is not communicated, if the petitioner were to file an appeal against such proceedings of the Deputy Commissioner within a period of six weeks from the date of receipt of certified copy of the order, the appeal to be

HC-KAR NC: 2025:KHC:47456 WP No. 34741 of 2025 entertained without raising any objection regarding delay. The notice at Annexure-A would be kept in abeyance for a period of eight weeks from today.
7. It is made clear that the protection granted would be in force if the petitioner were to file an appeal within the time stipulated in this order.
8. Needless to state, pending challenge to the order of the Deputy Commissioner, the notice at Annexure-A would be kept in abeyance till the conclusion of the appeal.
9. Accordingly, the petition is disposed off.
