ORDER:
The instant Criminal Petition is filed by the Petitioners under Section 482 of Cr.P.C. (Section 528 of B.N.S.S., 2023) for the following relief:
“ ... to direct the II Additional Junior Civil Judge, Tirupathi to dispose of C.C.No.598 of 2018 in Crime No.167 of 2018, registered by the East Police Station, Tirupathi, Chittoor District, under Sections 354, 509, 506, 323 IPC r/w. 34 IPC so far as the Petitioners / Accused Nos.1 and 2 as expeditiously as possible and to pass ...”
Respondent No.2, who is the de facto complainant, is working as Nurse in a cline of Dr.Venkat Ramaiah at Tirupathi. Petitioner No.1/A.1 is his friend. On the date of offence, Petitioner No.1/A.1 along with Petitioner No.2/A.2 came to the nursing home and requested respondent No.2 to cook food. At that time, Petitioner No.1/A.1 allegedly outraged her modesty, abused her in the name of her caste, Petitioner No.2/A.2, who is the stated to be the second wife of Petitioner No.1 also abused her.
On the complaint given by respondent No.2, a case in Crime No.167 of 2018 on the file of East Police Station, Tirupathi, Chittoor District against A.1 and A.2. After completion of investigation, Police filed a charge sheet against the Accused vide CC No.598 of 2018 on the file of the Court of II Additional Junior Civil Judge, Tirupathi. Seeking quashment of the said Proceedings, Petitioners/A.1 and A.2 filed the present criminal Petition. Heard Smt. B.V.Aparna Laskshmi, learned counsel for the Petitioners and Ms. Priyanka Lakshmi, learned counsel for respondent /State. Perused the material on record. 3
At the time of hearing, learned counsel for the Petitioners restricted the prayer and requested for a direction to the Trial Court for speedy disposal of the matter in CC No.598 of 2018. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. Considering the submissions and a fair look at the material on record, the Petitioners are made accused for the offences punishable under Sections 354, 509, 506 and 323 read with 34 IPC. The CC is of the year 2018. In that view, this Criminal Petition is disposed of. The Learned II Additional Junior Civil Judge, Tirupathi is directed to dispose of CC No.598 of 2018 as expeditiously as possible without granting any adjournments in a casual manner by mere asking and report the progress of the matter to the Registrar (Judicial) by 01.02.2026.
