JUSTICE ARINDAM LODH Order 21/03/2025 In terms of Order dated 20.03.2025, both the complainant and the accused-applicants are present before this Court. Heard Mr. S. Sarkar, learned senior counsel assisted by Mr. KD Singha, learned counsel appearing for the applicant, Sujit Debnath and Mr. P. Majumder, learned counsel appearing for the applicant, Asish Kumar Deb. Also heard Mr. R. Saha, learned Additional PP appearing for the respondent- State. When the above matters were taken up together, learned counsel appearing for the accused-applicants have submitted that the matters have been compromised amicably between the complainant and the accused- applicants. Mr. Sarkar, learned senior counsel has placed an affidavit before this court sworn by Sri Jayanta Biswas (informant/complainant of the case vide East Agartala PS case no. 136 of 2024). Mr. R. Saha, learned Additional PP has acceded to the submissions advanced by learned counsel appearing for the parties. I have gone through the affidavit. In the affidavit, the complainant stated inter alia that he alongwith his wife, Smt. Sampa Bhattacharjee have no grievance against the accused- applicant, Sujit Debnath. I have also interacted with the complainant, Sri Jayanta Biswas. While interacting, the complainant, Jayanta Biswas has fairly informed this court that he also has no grievance against the accused-applicant, Asish Kumar Deb, as he is not in any way related with the case. Having regard to the entire facts and circumstances, I am inclined to grant anticipatory bail to the applicants, namely, Sujit Debnath and Asish Kumar Deb. Accordingly, it is ordered that, in the event of arrest, the applicants, namely, Sujit Debnath and Asish Kumar Deb, may be released on bail on executing a bond of Rs. 50,000/- each with one surety each of the like amount to the satisfaction of the arresting authority. The affidavit, as placed by learned senior counsel shall be kept with the record. With above observations and directions, the instant anticipatory bail application stands allowed and thus disposed.
