YLR,J Crl.RNo.11896 of 2025 Dated 20.12.2025 The Court made the following: ORDER: The Criminal Petition has been fiied under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.4 & 5 on bail in Crime No.337 of 2025 of Machavaram Police Station, N.T.R.Commissionerate, registered against the Petitioners/Accused Nos.4 & 5 herein for the offences punishable under Sections 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity the BNS’). 2. Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor, submits that the investigation is not completed. The CCTV footage has not yet been retrieved. Some more witnesses are required to be examined, and it is urged to dismiss the petition. 3. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 4. It is brought to the notice by Mr.B.V.Krishna Reddy, the learned counsel for the Petitioners, that Accused Nos.1 and 3 in Crl.M.P.No.865 of 2025, Accused No. 2 in Crl.M.P.No.864 of 2025, and Accused Nos.6 to 14 in Crl.M.P.No.866 of 2025, vide separate orders dated 08.12.2025 were enlarged on bail by the learned Trial Court. This is the second bail application for Accused No. 4 and the first bail application for Accused No. 5. 'smm 3 Dr. YLR.J Crl.RNo.11896 of 2025 Dated 20.12.2025 5. The Petitioners/Accused Nos.4 & 5 were arrested on 15.09.2025. They have been in judicial custody for the past 96 days. The wife of the de-facto complainant committed suicide because of the grave insult and humiliation meted out by some transgenders at the behest of the main accused. Inquest and autopsy were conducted. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioners/Accused Nos.4 & 5, this Court is inclined to enlarge the Petitioners/Accused Nos.4 & 5 on bail. In the result, the Criminal Petition is allowed with the following stringent 6. 7. conditions: i. The Petitioners/Accused Nos.4 & 5 shall be enlarged on bail subject to them executing bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties each for the like sum to the satisfaction of the learned I Additional Chief Judicial Magistrate, Vijayawada, ii. The Petitioners/Accused Nos.4 & 5 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. iii.
