Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 of B.N.S.S., 2023 seeking transfer of Complaint Case No.175 of 2024, titled Smt. Moha Rai vs. Amit and others, under Sections 498A, 323 IPC, Police Station Sipri Bazar, District Jhansi, pending the in court of Additional Chief Judicial Magistrate (J.D.), court no.5, Jhansi to the competent court of jurisdiction at Mahoba. Concededly, the applicant/complainant herself filed a complaint under Section 498-A IPC etc. at district Jhansi, who has prayed for transfer of the case to district Mahoba on the ground that the accused are threatening her. A perusal of the paper book would show that the process against the accused was issued on 8th August, 2024 and learned counsel for the applicant is not aware, if the accused has put in appearance before the trial court. Thus, no exceptional ground is made out for transfer the case. This application is dismissed.
