G SRINIVASULA REDDY (SC FOR ZPP MPP AND GP SERVICES) The Court made the following: ::ORDER:: Heard Sri Skyam Rajasekhar, learned counsel for the petitioner and Sri G.Srinivasula Reddy, learned Standing counsel for the 3rd respondent. 2. The above contempt case was filed complaining of the violation of the order dated 23.08.2024, passed in W.P.No.18616 of 2024. 3. The petitioner filed the aforementioned writ petition to declare the action of the respondents 5 to 7 in the writ petition in not allowing the petitioner from discharging duties as Field Assistant, Pudivada Grama Panchayat, as illegal and arbitrary. 4. The writ petition was disposed of at the admission stage with the consent of both the learned counsel, and the operative portion of the order reads as follows: “Given the facts and circumstances of the case, the writ petition is disposed of at the admission stage with the consent of learned counsel on either side, with the following directions: i) Petitioner shall submit explanation to the memo in R.C.No.03/EGS/NAG/2024-25 dated 17.08.2024, by annexing all the relevant documents, to respondent No.5, within two weeks from today. ii) Respondent No.5, if opines that explanation needs to be considered by respondent No.2, shall forward the memo and explanation to respondent No.2 for passing appropriate orders. iii) Respondents 5 to 7 shall not obstruct the petitioner from discharging duties as Field Assistant, without following due process of law. No costs.” 4 5. In the affidavit filed in support of the contempt case, it was pleaded that the respondents have violated the order dated 23.08.2024. 6. Sri G. Srinivasula Reddy, learned Standing Counsel for the 3rd respondent, on instructions, would submit that in pursuance of the order, the petitioner submitted an explanation on 18.09.2024 through post. However, the petitioner has not attended duties. The respondents, vide letter dated 21.12.2024, informed the Project Director about the petitioner not attending duties. The Project Director, vide proceedings dated 05.02.2025, placed the petitioner under suspension. 7. Thus, as seen from the instructions of the 3rd respondent, despite the order in the writ petition, the petitioner failed to attend duties. The Project Director, District Water Management Agency (DWMA), placed the petitioner under suspension on 05.02.2025. 8. Given the facts and circumstances of the case, this Court does not find any violation of the order dated 23.08.2024 in W.P.No.18616 of 2024. 9. Accordingly, the contempt case is dismissed. No costs.
