PUBLIC PROSECUTOR The Court made the following: ...RESPONDENT/COMPLAINANT ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 to 5 for granting of pre-arrest bail in connection with Crime No.26 of 2022 of CID Police Station, Mangalagiri, registered for the alleged offence punishable under Sections 420, 403, 409 read with 120-B of Indian Penal Code (for short ‘the IPC’) and Section 13(2) of Prevention of Corruption Act, 1988 (for brevity ‘the Act’). 2 2. Perused the record. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. 3. Petitioner No. 1/Accused No.1 is a female aged about 55 years. Petitioner No.3/Accused No.3 is a female aged about 60 years. The petitioners originally availed a loan to the tune of about Rs. 50,00,000/- (Rupees Fifty Lakhs only). They could not repay the loan in time, and therefore the bank declared the loan account of the petitioners as a Non- Performing Asset (NPA). Later, pursuant to the intervention of mediators, one time settlement was arrived at between the State Bank of India and the petitioners for an amount of Rs. 81,00,000/- (Rupees Eighty-One Lakhs only). Petitioner No.1 paid Rs. 50,00,000/- (Rupees Fifty Lakhs only), but the remaining amount of Rs. 31,00,000/- (Rupees Thirty-One Lakhs only) was not paid by her. 4. Petitioner No.1 states that she could not pay the balance amount of Rs.31,00,000/- because the bank officials were not ready to hand over the original title deeds to the petitioners, as they required the petitioners to obtain a No Objection Certificate (NOC) from the CID. The petitioners, however, could not obtain the NOC. In the meantime, the one-time settlement lapsed due to non-compliance with its terms and conditions. The petitioners approached this Court by filing Writ Petition No. 17457 of 2024, in which the Hon’ble Division Bench passed an order on 09.08.2024, making it clear that 3 the bank officials may either accept or refuse to accept the balance amount, keeping in view their own commercial interests. Liberty was given to Petitioner No.1 to work out her appropriate remedies with the bank. Thereafter, the Regional Manager of the State Bank of India lodged a report with the CID, which was registered as FIR No.26 of 2022 on 18.05.2022 for the offences punishable under Sections 420, 403, 409 read with 120-B of ‘the IPC’ and Section 13(2) of ‘the Act’. Nearly three years have elapsed, the charge sheet has not yet been filed on the ground that some more witnesses remain to be examined. 5. Considering the transactions between the petitioners and the bank officials and facts and circumstances, the gravity and nature of the allegations levelled the Petitioners, this Court is inclined to grant pre-arrest bail to the Petitioners/Accused Nos.1 to 5. 6. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioners/ Accused Nos.1 to 5, they shall be enlarged on bail subject to they executing bonds for a sum of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties for the like sum each to the satisfaction of the arresting police officials; 4 The Petitioners/ Accused Nos.1 to 5 shall make themselves available for investigation and shall cooperate with the investigating officer for further investigation; The Petitioners/ Accused Nos.1 to 5 shall not cause any threat inducement or promise to the prosecution witnesses; III. The Petitioners/ Accused Nos.1 to 5 shall not leave the limits of Andhra Pradesh State without the express permission from the Station House Officer concerned. IV. The Petitioners/ Accused Nos.1 to 5 shall surrender their passports, if any, to the investigating officer.
