The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 19.01.2024 passed by Additional Sessions Judge, Court No. 2, Meerut in Session Case No. 440 of 2021, arising out of Case Crime No. 848 of 2020, whereby an application for Narco Test has been dismissed. Learned counsel for the applicant fairly admits that the applicant is accused in the case and three prosecution witnesses have been examined. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
