JUSTICE RAJESH RAI K ORAL ORDER In this Writ Petition, the petitioner has sought for a writ of mandamus for a direction to consider the representation of the petitioner dated 13.05.2016 as per Annexure-E submitted to respondent No.2-Special Deputy Commissioner. 2. The grievance of the petitioner is that he has filed Form No.7A in respect of land bearing Sy.Nos.108 and 109 before the Land Tribunal which was numbered as LRF.7A.153:99-00 and 116:99-00. The said proceedings are - 3 - HC-KAR NC: 2025:KHC:48279 WP No. 38584 of 2017 pending from the year 2009 and 2010. Though the petitioner submitted representation before the Land Tribunal to conduct the proceedings in LRF.7A.153:99-00 and 116:99-00 at the earliest, the Tahsildar had issued an endorsement dated 10.02.2010 stating that the notice has to be served on respondent No.4 i.e., owner of the subject land, as such delay has been caused in disposal of the case. 3. Subsequently, on 13.05.2016, petitioner submitted one more representation to the Special Deputy Commissioner, Bengaluru Rural District as per Annexure-E praying to dispose of the application filed under Form No.7A in LRF.7A.153:99-00 and 116:99-00. Even after, the Land Tribunal has failed to consider this application. 4. According to the petitioner, the proceedings are pending ever since 2010 without any valid reason. In such circumstance, I am of the considered view that the prayer of the petitioner requires to be considered. Accordingly, the writ petition is disposed of. Respondent Nos.2 and 3 are directed to dispose of the application of the petitioner in LRF.7A.153:99- 00 and 116:99-00 at the earliest. - 4 - HC-KAR NC: 2025:KHC:48279 WP No. 38584 of 2017 It is needless to state that before disposing the application, the Land Tribunal shall extend an opportunity to both the parties i.e., petitioner and respondent No.4 to put forth their case.
