Heard Sri B. Parameswara Rao, Ld. Counsel appearing on behalf of Sri N. Chandrasekhar, Ld. Counsel for the Writ Petitioners and Sri Abdul Rasheed, Ld. Asst. Government Pleader for Roads and Buildings and Sri T. Sanjeeva Rao, Ld. Asst. Government Pleader for Revenue. 2. Sri Abdul Rasheed, Ld. Asst. Government Pleader has submitted the Written Instructions dated 13.11.2025 (in both the Writ Petitions) furnished by the Executive Engineer, (R&B) Division, Machilipatnam. Copies of it are supplied to the Ld. Counsel for the Writ Petitioner and the same are taken on record. 3. The relevant portion of the Written Instructions furnished by the Executive Engineer, (R&B) Division, Machilipatnam is usefully extracted hereunder:
“I herewith submit that there is no R&B Road near the premises of the petitioner.
Further, there is no proposal under the purview of the R&B Department for widening of the road mentioned by the Petitioner and no action was initiated by the R&B department for eviction of the Petitioner's house. Therefore, the subject have no relation with R&B department. Therefore, it is requested to exempt Respondent 1, i.e., State of Andhra Pradesh rep. by its Principal Secretary, roads and Buildings department from the subject Writ Petition. This is submitted for favour of information.”
4. Sri T. Sanjeeva Rao, Ld. Asst. Government Pleader for Revenue has submitted the Written Instructions dated 15.10.2025 (in both the Writ Petitions) furnished by the Tahsildar, Vuyyuru. Copies of it are supplied to the Ld. Counsel for the Writ Petitioners and the same are taken on record. 4
5. The Written Instructions furnished by the Executive Engineer as extracted above, would clearly indicate that there is no R & B Road in the subject area. Similarly, the Written Instructions of Tahsildar would also indicate that the office of the Tahsildar has not received any information from the R & B Division and therefore, no precipitative action is proposed against the Writ Petitioners herein. 6. Having so recorded, these two Writ Petitions are disposed of. No order as to costs. 7. Needless to state that the Official Respondents shall follow the due process of law if any coercive measures are sought to be initiated against the Writ Petitioners. 8.
