JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred by the petitioner to enlarge him on bail in Crime No.191/2025 registered at Shivamogga Rural Police Station for the offence punishable under Section 109, 351(2) of BNS, 2023. 2. Investigation is completed and charge sheet is filed for the offence punishable under Section 109, 351(2) and 118(1) of BNS, 2023. 3. In the complaint lodged by one Yogesh S., he has alleged that he had lent a loan of Rs.1,00,000/- to the accused and inspite of repeated demand, the said amount was not returned. On 01.07.2025 at 7.00 p.m., accused met him near KEB Circle and took him near a water treatment plant, assuring that, he will return the money and all of a sudden, stabbed him with a knife on his head - 3 - HC-KAR NC: 2025:KHC:32922 CRL.P No. 11639 of 2025 and abdomen, with an intention to commit his murder. Further, when he hit him with a bag, the knife accused was holding fell down and thus he could escape from the spot. 4. The incident took place on account of a financial dispute between the petitioner and the complainant. It is stated that complainant was admitted at one Ashok Sanjeevini Hospital for treatment and got discharged on the very next day. As per wound certificate, he has sustained two injuries, stated to be simple in nature. Petitioner was arrested on 01.07.2025 and in judicial custody since then. Investigation is completed and charge sheet is filed. He has no criminal antecedents. Apprehension of the prosecution can be taken care of by imposing suitable conditions. Hence, the following: ORDER i. Petition is allowed. ii. Petitioner/accused in Crime No.191/2025 registered at Shivamogga Rural Police Station, shall be enlarged on bail, subject to following conditions: - 4 - HC-KAR NC: 2025:KHC:32922 CRL.P No. 11639 of 2025 1. He shall execute a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. 4. He shall not indulge himself in committing any offence. 5. He shall appear before the trial Court on every date of hearing without fail.
