M CHALAPATHI SRK, J W.P.No.22451 of 2015 3 The Court made the following ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent Nos.2 to 4 in seeking to evict the petitioner from her land to an extent of Ac.5.01 cents in Sy.No.16/1 situated at 59 Kothurupadu village, Addateegala Mandal, East Godavari District as illegal and arbitrary” 2. Case of petitioner is that she is the absolute owner and possessor of land to an extent of Ac.5.01 cents in Sy.No.16/1 situated at 59 Kothurupadu village, Addateegala Mandal, East Godavari District, but the respondent Nos.2 to 4 are trying to dispossess the petitioner from the lawful possession of the property at the instance of 5th respondent herein. 3. The learned Assistant Government Pleader, on written instructions submitted by 2nd respondent-Tahsildar, Addateegala, submits that the subject land in Sy.No.16/1 to an extent of Ac.2.00 cents is in possession and enjoyment of one Smt.Pothuri Mangayamma, w/o. Veerraju, without any lawful title, and the remaining extent of Ac.3.10 cents in survey No.16/1 is in SRK, J W.P.No.22451 of 2015 4 possession and enjoyment of Sri Pothuri Arjun, s/o. Veerraju and Smt.Pothuri Venkatalakshmi, w/o. Apparao (late), s/o. Veerraju. It is further submitted that total in survey No.16/1 admeasuring Ac.5.10 cents is in possession and enjoyment of Pothuri family members, and the revenue authorities are not trying to evict them over the said land. The written instructions submitted by 2nd respondent-Tahsildar, Addateegala are placed on record. 4. Recording the said submission of the learned Assistant Government Pleader, the Writ Petition is disposed of. The respondents are directed not to interfere with the petitioner’s peaceful possession and enjoyment of the subject property, except by due process of law. There shall be no order as to costs. 5.
