Sharma, learned counsel for the respondent Nagar Nigam. 2. By means of the present petition, the petitioner has mainly prayed for the following relief:- "a. Issue a writ, order or direction in the nature of Mandamus directing the respondent authorities to remove the street vendor (florist) occupying public footpath illegally and blocking the entry gate of the petitioner's complex and from the vicinity of the petitioner's complex." 3. Learned Addl. Chief Standing Counsel has submitted a report of the In-charge Chowki Civil Lines, Commissionerate Prayagraj which states that the encroachment in front of the shopping complex has been removed. Along with the said report she has also enclosed photographs. The report is taken on record and the same is reproduced herein below:- "ससादर अवगत करसानसा हहै कक मसानननीय उच्च न्यसायसालय इलसाहसाबसाद मम ययोजजित जसकवल कमस ररट पनीकटशन ससंख्यसा 15471/25 समनीर चन्दसा दसाददेश शदेणनी बनसाम उत्तर प्रददेश रसाज्य व 4 अन्य कदे अननुपसालन मम मनुझ उ 0 कन0 दसारसा मय पनुजलस बल उ 0 कन0 कवकसास वमसार, कसा० ब्रम्हजिनीत जससंह, ससंदनीप कनु मसार व उ 0 कन0 कवनय कनु मसार गनुरूददेव दसारसा आजि ममौकदे पर जिसाकर कदे घटनसास्थल कसा कनरनीक्षण ककयसा गयसा वहसाहाँ पर कवपक्षनी आकशफ पनुत्र गनुलसाम रससूल उफर बचऊ कनवसासनी कटरसा थसानसा कनरलगसंजि मयो 0 नसं0 9335158959 व अकबर पनुत्र भनुल्लन कनवसासनी चककयसा ससाथर मसंडवसा थसानसा हसंकडयसा प्रयसागरसाजि फसू ल गनुलदस्तदे ककी दनुकसान लगसाकर अकतक्रमण ककयदे हहए थदे। हम पनुजलस बल दसारसा ममौकदे पर अकतक्रमण कयो ससाफ करसायसा गयसा। ममौकदे पर ककसनी भनी प्रकसार कसा अकतक्रमण नहहीं हहै। कवपक्षनी आकशफ उपरयोक्त कयो सख्त कहदसायत ककयसा गयसा कक अब अगर इस तरह कसा अकतक्रमण आपकदे दसारसा ककयसा जिसाएगसा तयो आपकदे कवरूद मनुकदमसा पसंजिनीकक त कर आपकयो कहरसासत पनुजलस मम जलयसा जिसाएगसा।" 4. In view of the aforesaid fact, no cause of action survives in the present writ petition. Accordingly, the petition is dismissed as having become infructuous. 5. However, it is expected from the respondent authority that in case any such incident takes place in future, immediate action shall be taken and the encroacher shall be removed.
